Renters' Rights Bill

Abolishes Section 21 'no-fault' evictions, replaces ASTs with periodic tenancies, introduces a Decent Homes Standard for the PRS, bans rental bidding, and creates a national Landlord Ombudsman.

  • Section 21 abolished - possession only via Section 8 grounds
  • Periodic tenancies replace fixed-term ASTs
  • Right to request a pet (landlord cannot unreasonably refuse)
  • Mandatory PRS Database registration for every landlord

Decent Homes Standard (PRS)

The Decent Homes Standard, long applied to social housing, is being extended to all private rented properties. Homes must meet baseline standards for repair, facilities and thermal comfort.

  • Free from category 1 hazards (HHSRS)
  • Reasonable state of repair
  • Reasonably modern facilities and services
  • Reasonable degree of thermal comfort

Social Housing (Regulation) Act 2023

Strict timescales for landlords to investigate and fix damp, mould and other emergency hazards once reported by a tenant. Initially social sector, extending to PRS.

  • Investigate hazards within fixed timeframes
  • Begin repairs within set deadlines after diagnosis
  • Provide written reports to tenants
  • Failure may breach the implied tenancy term

Fire Safety (England) Regulations 2022

Strengthened duties on responsible persons in HMOs and blocks of flats - fire door checks, evacuation information, secure information boxes for taller buildings.

  • Annual fire door checks in common parts (HMOs/blocks)
  • Quarterly checks of flat entrance doors in higher-risk buildings
  • Smoke alarm on every storey, CO alarm in every room with a fixed combustion appliance

Electrical Safety Standards (PRS)

Electrical Safety Standards Regulations 2020

Landlords must ensure electrical installations are inspected and tested by a qualified person at least every 5 years (EICR), with a copy to tenants and the local authority on request.

  • EICR every 5 years, signed by a qualified electrician
  • Remedial works within 28 days of report (or sooner if specified)
  • Copy to new tenants before occupation

Tightening

Short-Term Lets (Airbnb-style)

Deregulation Act 2015 s.44

London's 90-night limit per calendar year remains; new national registration scheme for short-term lets is being introduced. Many councils now require planning permission for change of use.

  • London: max 90 nights/year without planning permission
  • Mandatory national STL registration scheme
  • Local planning controls in tourist hotspots
  • Public liability insurance strongly recommended
